Dacheng assisting domestic enterprise in completion of decoration, refitting and successful delivery of one ACJ319 neo business jet together with a leading offshore aircraft refitting center

Recently, a large domestic enterprise successfully redelivered an ACJ319 neo business jet purchased from Airbus after the completion of decoration and refitting by Jet Aviation. Ms. ZHOU Yao, senior partner of Dacheng Law Offices, and her team act as the heads of the project team for this Transaction and provide legal services on behalf of the Buyer to the entire process of aircraft decoration, refitting and delivery. Prior to this, the project team was in charge of the negotiation and signing of the purchase contract with Airbus, and the delivery of the "green plane" successfully completed by and on behalf of the Buyer.

Ms. Zhou Yao, on behalf of the Client, negotiated directly with Airbus on the aircraft purchase agreement, broke the common practice of manufacturer terms, accurately reflected the Client's individual requirements in the complicated contract terms so as to maximize protection of the Client's interests and eventually facilitated the execution of the purchase contract. On behalf of the Client, Ms. Zhou Yao, represented the Client in the whole process of meeting, negotiation and communication with Jet Aviation, a leading offshore aircraft refitting center on aircraft decoration and refitting related matters, conducted all-round comparison and analysis in respect of the selection of aircraft registering place during the refitting period and different routes in order to maximize control and manage the Client's tax and legal risks and eventually facilitated the execution of the aircraft refitting agreement. During the execution of the refitting agreement, based on the full understanding of the Client's decoration or refitting requirements and comments, the project team will timely give specific feedback to the refitting factory, assist in communication and actively follow up during the whole process, and finally procure the ACJ319 neo business jet to become a typical example of Jet Aviation's VVIP interior decoration. Meanwhile, Ms. Zhou Yao will coordinate with the domestic head aircraft operator to conduct discussion, research and communication with relevant parties on aircraft registration, import and custody and provide the client with the satisfactory registration, import and custody scheme so as to maximize the economic benefits and control the risk of re-registration, and assist the Client in carrying out execution of legal documents involved in the above processes.

In view of the professional problems involved in the process of the manufacturing, delivery from the factory, import, decoration and refitting, delivery after decoration and registration of new aircraft and new models, the project has proposed a new and practical solution from the legal perspective. It has a breakthrough significance to the field of aviation finance and provides referential experience for the bank to choose new aircraft on behalf of other domestic enterprises in the future.
