Two Cases Handled by Dacheng's Employment and Labor Lawyers Selected for the "People's Court Case Database "

Posting Date: 2024.03.13

On February 28, 2024, the Supreme People's Court (SPC) of the People's Republic of China held a press conference to announce the official launch of the People's Court Case Database, now accessible to the public. The establishment of this database aims to promote uniformity in judicial rulings and standards, preventing the occurrence of "same case, different verdicts". The database includes authoritative cases that SPC reviews to have demonstrative reference value, including guiding cases and reference cases.

Included in the initial batch of the database are 57 labor dispute and work-related injury cases, with two cases represented by Dacheng's lawyers being selected as reference cases. These two cases include the labor dispute case of Dong XX vs. a publishing house, represented by lawyers Zhang Lijie and Weng Fei (Case No. 19), and the labor dispute case of Sun XX vs. a decoration company, represented by lawyer Zhou Ming (Case No. 28). Both cases closely relate to the people's well-being and highlight issues such as determining whether a case qualifies as a labor dispute or a personnel dispute based on the parties' claims and the objective circumstances of the case; the eligibility of workers to continue fulfilling employment contracts after conversion of public institutions to enterprises; the legal qualifications of retired servicemen who have not yet reached the statutory retirement age and have not received pension benefits for establishing a labor relationship; and the abbreviature of adjudication that employer's statutory obligation to sign a written labor contract with the employee cannot be waived due to any confusion regarding the employee's status. The inclusion of these cases provides precise and authoritative case handling references and research materials for legal professionals in the judicial community, showcasing Dacheng lawyers' expertise in the practice area of employment and labor.

Dacheng's lawyers specializing in employment and labor law see this successful inclusion as a valuable opportunity to deepen their knowledge and research. They are dedicated to continuously enhancing their professional skills and comprehensive capabilities. The firm is committed to providing clients with high-quality, specialized legal services while actively fulfilling its social responsibilities to promote harmonious labor relations and uphold social fairness and justice.
