Dacheng provides services for the construction of the compliance management system for import and export control for a centrally-administered enterprise group

Recently, Ms. Yan Liping, a senior partner of Dacheng Law Offices, served as the person in charge of a team to carry out the project of providing services for the construction of the compliance management system for the import and export control for a centrally-administered enterprise group and its subsidiary.

Ms. Yan is a member of the ISO International Organisation's expert panel on legal risk management, participated in the formulation of ISO 31022 international standards on legal risk management, and has been in the field of compliance and risk management for many years. Yan Liping and her team made full use of their experience in compliance management over the years in providing China Railway Group, China Energy Construction, Harbin Electric and other state-owned enterprises, especially the head offices of such groups, based on the companies' existing compliance management system and in combination with the nine factors (i.e. drafting a policy statement, establishing an organizational structure, conducting a comprehensive risk assessment, establishing a review procedure, formulating an emergency measure, conducting education and training, improving the compliance audit, keeping files and documents, and preparing a management manual) issued by the Ministry of Commerce (the "Guiding Opinions on the Compliance of Export Control").

The overall idea of the project is as follows: 1. meet the actual needs for the four-integrated construction of laws, compliance, risk control and internal control; 2. meet the compliance requirements for export control; 3. carry out compliance risk screening in light of the scope of investigation of liability of centrally-administered enterprises for violations; 4. meet international compliance requirements; and5. put risk isolation measures in place.

Through compliance management projects, we should help enterprises to complete the requirements of the "Year of Strengthening Compliance Management" work deployment meeting proposed by the State-owned Assets Supervision and Administration Commission of the State Council in December 2021, promote enterprises to speed up breaking through difficulties and improving weakness, promote the implementation of compliance management in an in-depth and practical manner, and really give play to the important role of standardized management, risk prevention and control, support and guarantee. We should create a good trend of development for companies that is healthy, compliant, stable and rapid, and build centrally-administered enterprises with the legal system.
