Dacheng Lawyer Invited to Lecture at the Seminar for Cuban Judges Hosted by the Ministry of Commerce

In March 2024, the Seminar for Cuban Judges, hosted by the Ministry of Commerce of the People's Republic of China and organized by the Fujian Center for Foreign Economic Cooperation, officially commenced in Fuzhou, with lectures conducted offline. On March 28, lawyer Chen Jie, a partner of Dacheng Fuzhou, was invited to give a special lecture on the Civil Code of the People's Republic of China, aiming at enhancing Cuban judges' understanding of the design of China's civil law system.

 

As a fellow legal professional, Chen Jie started the lecture with an introduction to the origins and compilation of the current Civil Code in China. He then elaborated on its innovative significance, contemporary relevance, and cultural importance in sequence, detailing its six fundamental principles, chapter arrangement, and various civil rights systems. Finally, he focused on the system design of the Book of Contracts of the Civil Code, systematically demonstrating China's multi-value protection of civil rights.

 

Chen Jie delivered a comprehensive interpretation of key innovations introduced by the Civil Code, including the persons of the civil law, codifying personality rights law as a separate Book, enhanced ownership of a building's units, rights of habitation, security interests, electronic contracts, standard clauses, improved typical contract systems, a cooling-off period for divorces, and tort liability. During the session, as Cuban judges expressed significant interest in the newly introduced rights of habitation, Chen Jie gave a detailed explanation of the legislative purposes, legal foundations, specific arrangements, and legislative safeguards. Furthermore, he engaged in a thorough discussion with the Cuban judges on the legal challenges encountered in judicial practice regarding rights of habitation.

 

This seminar not only enhanced mutual understanding between Chinese lawyers and Cuban judges but also exemplified Dacheng lawyers' commitment to advancing China's international cooperation and exchanges.
